Terms & Conditions

This document constitutes the Terms and Conditions under which you have engaged Kent Nannies for the introduction of a nanny. Kent Nannies (hereinafter called the “Agency”) will seek to provide you, the client with a suitable Candidate for employment as a nanny.

LIABILITY

The Agency takes every possible care in the selection of a candidate, but it is for you the client to satisfy his/herself as to the final suitability of the candidate. The Agency will obtain references in respect of any Candidate and these will be provided to you, the client, for your consideration to assist you in assessing the suitability of the Candidate. The Agency cannot accept any responsibility for any loss¸ liabilities, expenses, claims or damages, which may arise out of the employment of a Candidate.

For the avoidance of doubt, the agency does not exclude liability for death or personal injury arising directly from its own negligence. The Agency cannot guarantee or warrant the good conduct of the nanny.

The Agency at all times acts as a Placement Agency and Introductory Agency for the provision of nannies. The Agency does not directly employ or in any way provide the services of the candidate. You will at all times be responsible once you have agreed an engagement for the candidates taxes and national insurance contributions, whether or not you are employing the candidate on a temporary or full time capacity and will be responsible for providing a detailed pay-slip.

FEES

Upon the successful introduction of a suitable candidate, you will be liable for an introduction fee set out in our scale of charges. The introduction fee will be charged on every successful introduction. The introduction fee is to be paid within 7 days of the invoice date and all payments should be made to Kent Nannies. No refund will be given in circumstances where the client retains the services of the candidate, even though the client considers the candidate unsatisfactory. Refunds will only be made to clients who have paid the placement fee within the 7 day payment period. Any overdue accounts will be charged a 10% surcharge by the agency.

Should the engagement relating to a permanent nanny be cancelled by either party within 8 weeks of starting, and if the agency has been informed of this verbally, we endeavor to find a suitable replacement (only one free replacement will be made). If no suitable replacement can be found a refund will be made according to the table below.

CANCELLATIONS

If a client, who has booked a nanny or other child-carer cancels the booking for any reason before the placement begins, then the client shall pay the nanny one weeks wages at the negotiated rate and the client will also pay Kent Nannies a £95 fee to cover administration costs.

THIRD PARTY INTRODUCTIONS

Information passing between the client and the Agency in connection with any placement is confidential and any placement by a client to a third party of a candidate introduced by the Agency, will incur the relevant introduction fee. In the case of the candidate returning to a position at a future date, the relevant placement fee will be payable for the relevant position. The client agrees to notify the agency of re-engagement.

These terms and conditions of business are governed by the law of England & Wales and are subject to the exclusive jurisdiction of the courts of England & Wales.
